In addition, we are not in any way responsible for the actions of any of our clients, including the sending of illicit, unwelcome, spam, or any other kinds of emails using email addresses which are hosted by LIT Creations.

Fees Payable
LIT Creations operate on a payment upfront business model. A client requesting services will be quoted the costs and will be advised what portion (or in some cases the full amount) is payable upfront. Please note that any design payment made upfront is non refundable when design work has begun on that project. Only upon receipt of payment, will a project be opened for the services requested.

All prices quoted to clients in quotes, salesorders or invoices are quoted with the understanding that LIT Creations will host the website, unless specifically stated otherwise. For more information about non-hosted design prices, please click here.

Server Type
All sites will be hosted on a Windows 2003 server with ASP enabled, as a default server. If the client explicitly requests it, the hosting can be moved to a Linux server instead.

Scripting Support
We offer scripting support for all scripts which we have written. We do not offer support for any scripts not written by LIT Creations, even if these scripts reside on our hosting platform. A client may request support on a particular script and will be quoted a fee for the support requested.

Logo Designs
LIT Creations create logo designs at a very affordable rate. Therefore, when requested to design a logo, we will design 3 varying logos. The client needs to select one of these logos. If none of the logos is selected, the client may choose between the following options:

Client may opt to get one of the logos sent to them in high resolution format and may from there approach another design company.
Client may opt to pay another logo design fee to LIT Creations and we will again design 3 varying logos, from which the client will again be urged to select one logo.
Client may select one of the logos they liked the best, and LIT Creations will tweak the logo to the client’s specifications until client is satisfied. These amendments to the logo will be charged at our hourly rate to the client.

Let it be noted that LIT Creations will not provide a refund for logos already created for a client, even if the client does not like any of the logos presented.

Business Card Designs
If contracted to do so, LIT Creations will design a business card for a client, using specifications provided by the client. One set of changes (see “Definitions” below) can be requested to the initial design created. Thereafter, the changes to the card design will be charged at our hourly fee.

Website Designs
Websites are designed in the following phases:

PHASE 1: Template design (which is sent to the client as a jpg image). This is the designer's depiction of the website and proposal on how the site should look. The template design is based on the colours and look & feel of the logo and content which the client provides. We can also source imagery for the client, which will be based on the type of business of the client. After receipt of the proposed template, the client can suggest two sets of changes (see “Definitions” below) to the template, which we then do, and send back in jpg format once again to the client. More than two sets of changes will be charged at our hourly rate. The template includes the colours, imagery, layout, spacing of items, naming of buttons, page headings and description of animation.

PHASE 2: Website design phase will be based on approved template design. This phase includes the design and population of all static pages with copy and possibly additional imagery, as well as all animation designs. The client can hereafter make two sets of changes to the copy of the site in the various pages (not template changes). Template changes requested at this point will incur an additional cost which will be based on our hourly fee.

If the client's site is a straight-forward design without development functionality (such as shopping cart or admin functionality etc), then the project ends here. However, if there is additional development to be added to the site, it goes to phase 3.

PHASE 3: If the client requires development on the site, like shopping carts or admin functionality, the design is sent to the developer for this phase. The client is presented with a working version of the site, loaded onto our test server for review and testing. Any errors which the client may find will of course be corrected in the site at this point. Once the go-ahead is given to take the site live, it is assumed that the client has tested the site in its entirety and has ironed out any discrepancies or errors. Once the site is live, any additional changes / corrections requested will be treated as a new project and will be charged for accordingly.

Once the client gives the go-ahead for a site to be taken live, it is assumed that the client has properly tested the site on the test server. The project is then closed and any further updates requested to the site thereafter will constitute a new project and will therefore incur additional costs, which will be quoted to the client as a new project.

Website Designs - Sites Not Hosted with LIT Creations
If a client contracts LIT Creations to design a site which is not to be hosted on our servers, it should be noted that our designs are written in ASP script, with the occasional use of Javascript. The scripts are written to be supported on our servers, which run Windows 2003 with IIS, and ASP enabled. Forms that generate emails use CDONT functionality. The client should ensure that their servers support the same platform if contracting LIT Creations to design their website. We do not offer support for client servers, or scripting on servers which are not hosted with us.

Search Engines
LIT Creations do not offer any guarantees in terms of search engine acceptance, nor ranking on any particular search engine. We believe our code is generally optimised for search engines, with the inclusion of META tags. We will do a single bulk search engine submission when a site goes live. Software used for the bulk search engine submission is Dynamic Submission.

Domain Registrations and Transfers
A domain registered through LIT Creations will always be registered in the name of the client / client's company. A domain may be transferred to another hosting provider at any stage. The client needs to fax us a signed letter indicating their intent to transfer the domain name, before any transfer will be accepted for a domain name.

Hosting Transfers
A client may choose to transfer their hosting from LIT Creations to another service provider. A client may request the website and images files from LIT Creations. These files will be zipped and emailed to the client upon request. The files which will be sent to the client will include all pages of the site, any CSS files or included files, all MS Access databases and all image files (jpg or gif). The PSD, FLA, CDR or any other design files remain the property of LIT Creations and will not get sent to the client. The first year's hosting monies are not refundable. Starting from the second year of hosting, should the client wish to transfer their hosting to another provider, they may request a refund of hosting money which was paid upfront for the year, which will be calculated by LIT Creations on a pro-rata basis. Should LIT Creations terminate the hosting contract for any reason (please see "Cancellation of services" below), a refund will be issued to the client for hosting monies paid upfront on a pro-rata basis, whether the client is in the first year of hosting or not.

Note that the above paragraph refers to the basic hosting package only. Any add-on services, such as Advanced Mailboxes, gTLD domains, SSL, MS SQL Server databases or MySQL databases, MatrixStats, Mailbox Control Panels, etc are non-refundable items.

Hosting Renewal Notification
LIT Creations will send the client notification to renew their hosting service approximately 30 days before expiry and again approximately 14 days before expiry and again approximately 5 days before expiry. Hereafter we will also try to phone the client. The renewal notices will be sent to the email address(es) specified by the client when originally signing up with LIT Creations. It is the client's responsibility to notify LIT Creations of any changes in contact information. Should no payment be received before the expiry date specified in the email sent to the client, the hosting service will be deleted from our servers on the date of expiry (or for certain types of services like, inter alia, Advanced Mailboxes or MatrixStats, 2 days prior to the expiry date). LIT Creations are not responsible or liable for any loss of data or information due to a service deletion.

Server Use
LIT Creations reserves the right to refuse service and/or access to its servers and/or services to anyone. LIT Creations does not allow any of the following content to be stored on its servers:

Adult material - includes all pornography, erotic images, or otherwise lewd or obscene content.
Excessive download content or non-linked content.
Any files that are not related to or linked to a website are prohibited.
Bulk mailing from websites with the use of forms is prohibited.
Audio or video files are prohibited unless the files are run through streaming media or if the file sizes are less then 300KB each.

Refusal of service based on content matching any of the above criteria is entirely at the discretion of LIT Creations. LIT Creations reserves the right to move your data to a different server with no previous notice.

Unlimited Use Policy
High bandwidth usage: LIT Creations offers an unlimited use policy by maintaining very large ratios of bandwidth per customer. In rare cases, LIT Creations may find a customer to be using server resources to such an extent that he or she may jeopardize service performance and resources for other customers. In such instances, at our discretion, LIT Creations reserves the right to impose the High Resource User Policy for the consideration of all customers.

Unlimited emails hosted on a domain with control panel: Note that the unlimited use offered is aimed at small to medium businesses and not for reseller purposes. Therefore if more than 1000 emails are required, it is better to get a dedicated server to deal with the load, rather than making use of the shared hosting platform.

High Resource User Policy
Resources are defined as bandwidth, processor utilization or disk space.

LIT Creations may implement the following policy to its sole discretion:

When the resources utilised by a customer in using a service are abnormally high, LIT Creations reserves the right to suspend that service immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our services. Customers may be offered an option whereby LIT Creations continues supplying the service under a reduced usage criteria specified by LIT Creations. Failure to comply with such measures may result in your service being terminated.

Uploads via scripting languages
We limit uploads made via scripting languages - including PHP, ASP and ASP.NET. Uploads made using PHP are limited to 20MB per file.

Email Addresses
All email accounts set up for a client on our servers will be Basic (Standard) Mailboxes. A Basic Mailbox is allocated 50MB of space on the server. Basic Mailboxes do not come with anti-virus or anti-spam checking software on the server. All mentions made to emails on this website are indicative of Basic Mailboxes, unless explicitly otherwise mentioned.

Cancellation of services
LIT Creations reserves the right to cancel a client's hosting services at any stage, giving a refund of certain monies paid. The design payment made upfront for new website projects is non refundable. Furthermore the refund also excludes the purchase of any items for which a refund cannot be provided, such as domain name registrations, MatrixStats, SSL, Advanced Mailboxes etc. LIT Creations will give the client 30 days to find another suitable hosting company for their site. After the 30 day notice period, the client's website, email and other hosted services will be deleted from our servers.

Resellers of our services
Design companies and individuals may resell our services and we will contact only the reseller for hosting renewal and/or other notifications. However, if we are unable to contact the reseller for one of their client's hosting renewals, we will be forced to contact the client directly to give them the option of renewing their hosting directly with us. It is therefore up to the reseller to keep us informed of address / contact information changes. Should a reseller's client contact us directly at any time and possibly request our pricing, we will treat this client like any other and divulge our pricing and service information directly to the client. The client may then choose to deal directly with LIT Creations instead of their reseller. LIT Creations are in no way responsible for any possible financial or other losses incurred by a reseller should a client contact us directly.

Terms & Conditions
The Terms & Conditions listed in this page may be changed at any given time and without prior notice to clients. It is the client's responsibility to check this page on a regular basis for updates.

Definitions:
“Set of changes” – this is defined as a SINGLE email from the client with a list of changes for the design that was sent to the client by LIT Creations.
